Welcome to the BreakupHelper Creator Program. This Creator Agreement ("Agreement") is a legally binding contract between you ("Creator," "you," "your") and BreakupHelper ("we," "us," "our") that governs your use of our platform to sell content.
By clicking “Become a Creator” and submitting content to the Service, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement, in addition to our main Terms of Use and Privacy Policy.
1. Creator Status & Responsibilities
- Becoming a Creator: By accepting this Agreement, you are immediately granted Creator status. This allows you to access our tools to create, edit, and submit lifestyle guides ("Blueprints") for sale in our store.
- Content Authenticity: You agree that all content you submit is based on your own authentic experience and knowledge. You commit to providing information that is safe, responsible, and honest.
- Safety & Compliance: All fitness-related Blueprints must be achievable without the use of anabolic steroids or other performance-enhancing drugs. All mental and emotional health-related Blueprints must not make unlicensed clinical claims or present themselves as a substitute for professional therapy.
2. Content Submission and Review
All Blueprints submitted to the platform are subject to a mandatory review by the BreakupHelper team before being published. We reserve the right, at our sole discretion, to reject or unpublish any content that violates our guidelines, promotes unsafe practices, contains false claims, or is not aligned with our community standards. Every edit you make to a published Blueprint will trigger a new review.
3. Commission and Payments
- Commission: We retain a 5% commission from the final sale price of each Blueprint you sell. The remaining 95% is your "Creator Revenue."
- Payment Schedule: Creator Revenue will be paid out on a monthly basis, approximately 30 days after the end of the month in which the sales occurred (e.g., revenue from sales in March will be paid out around the end of April).
- Payment Hold: This 30-day hold period is necessary to account for customer refunds, payment disputes, or chargebacks.
- Payment Processor: All payments will be processed through a secure, third-party service (e.g., Stripe Connect). You will be required to set up an account with our payment partner and agree to their terms of service to receive payouts.
4. Intellectual Property Rights
- You Own Your Content: You retain full ownership of all the intellectual property rights to the content you create and upload to your Blueprints.
- License to Us: By submitting a Blueprint, you grant BreakupHelper a non-exclusive, worldwide, royalty-free license to host, display, market, sell, and distribute your content on and through our Service. This license is necessary for us to operate the store and allows you to use your content elsewhere if you choose. This license ends when your content is removed from our platform.
5. Representations and Warranties
You represent and warrant that:
- You are the original creator of your content and have all necessary rights to grant us the license described above.
- Your content does not and will not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party.
- All information you provide is accurate, and all health and wellness claims are made responsibly and in accordance with our guidelines.
6. Term and Termination
This Agreement begins when you accept its terms and continues until terminated. You may terminate this Agreement at any time by deleting your creator account or requesting the removal of all your Blueprints. We may terminate this Agreement or suspend your creator account at any time if you breach these terms.
7. Governing Law
This Agreement shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
